Acuvea Healthcare Technologies Private Limited holding the business name, “Medicapp”, ("medicapp", "Company", &; "We", "Our" or "Us" which also includes its affiliates) is the author, publisher and owner of the internet resource medicapp.in (“Website”) on the world wide web as well as the software and applications (the URLs, web and mobile applications together referred to as "Websites" and individually a "Website") provided by Medicapp, including but not limited to the mobile application ‘Medicapp’, and the software and applications of the sub-domain pro.medicapp.in (For Healthcare Providers, HCP). The terms 'You' or 'Your' refer to You as the user (whether You are a Registered User, Unregistered user or an HCP) of the Website or of the services offered by the Website ("Service").

This privacy policy ("Privacy Policy") explains how we collect, use, share, disclose and protect Personal information about the Users of the Services, including the Healthcare Providers (as defined in the Terms of Use, accessible via the followed web-link https://pro.medicapp.in/termsCondition (the “Terms of Use”)), the End-Users (as defined in the Terms of Use), and the visitors of Website (jointly and severally referred to as “you” or “Users” in this Privacy Policy). We created this Privacy Policy to demonstrate our commitment to the protection of your privacy and your personal information. Your use of and access to the Services is subject to this Privacy Policy and our Terms of Use. WHY THIS PRIVACY POLICY?

This Privacy Policy is published in compliance with, inter alia:

Section 43A of the Information Technology Act, 2000;

Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”);

Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

The type of information collected from the Users, including Personal Information (as defined in paragraph 2 below) and Sensitive Personal Data or Information (as defined in paragraph 2 below) relating to an individual;

CONSENT

By clicking on the "I accept' button at the end of page containing the Terms of Use or by providing us Your Personal Information or by making use of the features provided by the Website, You hereby consent to the collection, storage, processing, disclosure and transfer of Your Information in accordance with the provisions of this Privacy Policy.

You acknowledge that you are providing Your Personal Information out of Your free will.

You have the option not to provide us the Personal Information sought to be collected. You will also have an option to withdraw your consent at any point, provided such withdrawal of consent is intimated to us in writing at support@medicapp.in. CHANGES TO THE PRIVACY POLICY

We may update this Privacy Policy from time to time. There is a tab at the end of the Privacy Policy which indicates when the Privacy Policy was last updated.

When We update Our Privacy Policy, the next time You visit the Website, the Website will provide a message which will intimate You of the amendments to the Privacy Policy. You will be required to provide Your consent to the amendments before You proceed. If You do not agree to the amendments, please do not use the Website any further.

The information collected from you by Medicapp may constitute ‘personal information’ or ‘sensitive personal data or information’ under the SPI Rules.

“Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.

The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to:

passwords;

financial information such as bank accounts, credit and debit card details or other payment instrument details;

physical, physiological and mental health condition;

sexual orientation;

medical records and history;

biometric information;

information received by body corporate under lawful contract or otherwise;

visitor details as provided at the time of registration or thereafter; and

Call data records.

Medicapp will be free to use, collect and disclose information that is freely available in the public domain without your consent.

For instance, You may provide Your health related information on the Website in order to consult privately with an HCP, or You may provide Your financial information in order to process a payment which You need to make on the Website.

to provide You with information about products and services available on the Website;

to personalize Your experience on the Website;

to help You address Your problems incurred on the Website including addressing any technical problems;

for proper administering of the Website;

to conduct internal reviews and data analysis for the Website (e.g., to determine the number of visitors to specific pages within the Website);

to improve the services, content and advertising on the Website;

to protect the integrity of the Website; and

to respond to judicial process and provide information to law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law.

HOW INFORMATION MAY BE SHARED AND TRANSFERRED?

We may exchange, transfer, share, part with all or any of Your Information, across borders and from Your country to any other countries across the world with Our affiliates / agents / third party service providers / partners / banks and financial institutions for the Purposes specified under this privacy Policy or as may be required by applicable law or in case of sale, acquisition, merger or bankruptcy involving Medicapp.

You acknowledge that some countries where We may transfer Your Information may not have data protection laws which are as stringent as the laws of Your own country.

You acknowledge that it is adequate that when Medicapp transfers Your Information to any other entity within or outside Your country of residence, Medicapp will place contractual obligations on the transferee which will oblige the transferee to adhere to the provisions of this Privacy Policy.

HOW WE PROTECT YOUR INFORMATION?

The security of Your Personal Information is important to us. We have adopted reasonable security practices and procedure to ensure that the Personal Information (protected health information) collected is secure. You agree that such measures are secured and adequate. We restrict access to Your Personal Information to Our and Our affiliates' employees, agents, third party service providers, partners, and agencies who need to know such Personal Information in relation to the Purposes as specified above in this Privacy Policy and provided that such entities agree to abide by this Privacy Policy.

While We will endeavor to take all reasonable and appropriate steps to keep secure any information which We hold about You and prevent unauthorized access, You acknowledge that the internet is not 100% secure and that We cannot provide any absolute assurance regarding the security of Your Personal Information. We nor any of the HCP on Medicapp will not be liable in any way in relation to any breach of security or unintended loss or disclosure of information caused by Us in relation to Your Personal Information.

COOKIES

We may store temporary or permanent 'cookies' on Your computer. A cookie is a small piece of data that is sent to Your browser from a web server and stored on Your computer's hard drive. A cookie cannot read data off Your hard disk or read cookie files created by other sites. Once You close Your browser, the cookie simply terminates. For instance, by setting a cookie on Your browser, You would not have to log in a password more than once, thereby saving time while on the Websites. You can choose whether to accept cookies by changing the settings of Your browser. You can reset Your browser to refuse all cookies or allow Your browser to show You when a cookie is being sent. If You reject the cookies on the websites, You may still be able to use the Websites, but it shall be limited to certain minimal functionality. The third party sites are not under the control of Medicapp. Please note that Medicapp is not responsible for the privacy practices of such third party sites. Medicapp encourages You to be aware when You leave the Websites and to read the privacy policies of each and every third party site that collects personal information. If You decide to access any of the third-party sites linked to the Websites, You do this entirely at Your own risk. Any links to any partner of the Websites is the responsibility of the linking party, and Medicapp shall not be responsible for notification of any change in name or location of any information on the Websites.

CORRECTING INACCURACIES OR PERSONAL INFORMATION

If Your Personal Information changes, or if You need to update or correct Your Personal Information or have any grievance with respect to the processing or use of Your Personal Information, for any reason, You may send updates and corrections to us at support@medicapp.in and We will take all reasonable efforts to incorporate the changes within a reasonable period of time. If Your Personal Information is stored as part of Your profile on the Website, You can update Your profile on the profile pages of the Websites. You are not allowed to use the Website or the Services of the Website if any of the terms of this Privacy Policy are not in accordance with the applicable laws of Your country.

You are not allowed to use the Website or the Services of the Website if any of the terms of this Privacy Policy are not in accordance with the applicable laws of Your country.

PRIVACY STATEMENTS

ALL USERS NOTE:

This section applies to all users.

Accordingly, a condition of each User’s use of and access to the Services is their acceptance of the Terms of Use, which also involves acceptance of the terms of this Privacy Policy. Any User that does not agree with any provisions of the same has the option to discontinue the Services provided by Medicapp immediately.

An indicative list of information that Medicapp may require you to provide to enable your use of the Services is provided in the Schedule annexed to this Privacy Policy.

All the information provided to Medicapp by a User, including Personal Information or any Sensitive Personal Data or Information, is voluntary. You understand that Medicapp may use certain information of yours, which has been designated as Personal Information or ‘Sensitive Personal Data or Information’ under the SPI Rules, (a) for the purpose of providing you the Services, (b) for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, (c) for sale or transfer of such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates (d) for communication purpose so as to provide You a better way of booking appointments and for obtaining feedback in relation to the Healthcare Providers and their practice, (e) debugging customer support related issues.. (f) for the purpose of contacting you to complete any transaction if you do not complete a transaction after having provided us with your contact information in the course of completing such steps that are designed for completion of the transaction. Medicapp also reserves the right to use information provided by or about the End-User for the following purposes:

Publishing such information on the Website.

Contacting End-Users for offering new products or services.

Contacting End-Users for taking product and Service feedback.

Analyzing software usage patterns for improving product design and utility.

Analyzing anonymized practice information for commercial use.

If you have voluntarily provided your Personal Information to Medicapp for any of the purposes stated above, you hereby consent to such collection and use of such information by Medicapp. However, Medicapp shall not contact You on Your telephone number(s) for any purpose including those mentioned in this sub-section 4.1 (iii), if such telephone number is registered with the Do Not Call registry (“DNC Registry”) under the PDPA without your express, clear and un-ambiguous written consent.

Collection, use and disclosure of information which has been designated as Personal Information or Sensitive Personal Data or Information’ under the SPI Rules requires your express consent. By affirming your assent to this Privacy Policy, you provide your consent to such use, collection and disclosure as required under applicable law.

Medicapp does not control or endorse the content, messages or information found in any Services and, therefore, Medicapp specifically disclaims any liability with regard to the Services and any actions resulting from your participation in any Services, and you agree that you waive any claims against Medicapp relating to same, and to the extent such waiver may be ineffective, you agree to release any claims against Medicapp relating to the same.

You are responsible for maintaining the accuracy of the information you submit to us, such as your contact information provided as part of account registration. If Your personal information changes, you may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us through privacy@medicapp.in. We will make our best efforts to make requested changes in our then active databases as soon as reasonably practicable. If you provide any information that is untrue, inaccurate, out of date or incomplete (or becomes untrue, inaccurate, out of date or incomplete), or Medicapp has reasonable grounds to suspect that the information provided by you is untrue, inaccurate, out of date or incomplete, Medicapp may, at its sole discretion, discontinue the provision of the Services to You. There may be circumstances where Medicapp will not correct, delete or update your Personal Data, including (a) where the Personal Data is opinion data that is kept solely for evaluative purpose; and (b) the Personal Data is in documents related to a prosecution if all proceedings relating to the prosecution have not been completed.

If you wish to cancel your account or request that we no longer use your information to provide you Services, contact us through support@medicapp.in. We will retain your information for as long as your account with the Services is active and as needed to provide you the Services. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a period of time, your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes. Please note that your withdrawal of consent or cancellation of account may result in Medicapp being unable to provide you with its Services or to terminate any existing relationship Medicapp may have with you.

If you wish to opt-out of receiving non-essential communications such as promotional and marketing-related information regarding the Services, please send us an email at support@medicapp.in or support-doctors@medicapp.in or support-sellers@medicapp.in from your respective Patient App or Doctor App or Seller App.

Medicapp may require the User to pay with a credit card, wire transfer, debit card or cheque for Services for which subscription amount(s) (if any) is/are payable. Medicapp will collect such User’s credit card number and/or other financial institution information such as bank account numbers and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such credit card number and information to third parties as necessary to complete such billing operation. Verification of credit information, however, is accomplished solely by the User through the authentication process. User’s credit-card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. However, Medicapp provides you an option not to save your payment details. User is advised, however, that internet technology is not full proof safe and User should exercise discretion on using the same.

Due to the communications standards on the Internet, when a User or the End-User or anyone who visits the Website, Medicapp automatically receives the URL of the site from which anyone visits. Medicapp also receives the Internet Protocol (IP) address of each User’s computer (or the proxy server a User used to access the World Wide Web), User’s computer operating system and type of web browser the User is using, email patterns, as well as the name of User’s ISP. This information is used to analyze overall trends to help Medicapp improve its Service. The linkage between User’s IP address and User’s personally identifiable information is not shared with or disclosed to third parties. Not withstanding the above, Medicapp may share and/or disclose some of the aggregate findings (not the specific data) in anonymized form (i.e., non-personally identifiable) with advertisers, sponsors, investors, strategic partners, and others in order to help grow its business.

The Website uses temporary cookies to store certain (that is not sensitive personal data or information) that is used by Medicapp and its service providers for the technical administration of the Website, research and development, and for User administration. In the course of serving advertisements or optimizing services to its Users, Medicapp may allow authorized third parties to place or recognize a unique cookie on the User’s browser. The cookies however, do not store any Personal Information of the User. You may adjust your internet browser to disable cookies. If cookies are disabled you may still use the Website, but the Website may be limited in the use of some of the features.

A User may have limited access to the Website without creating an account on the Website. Unregistered Users can make appointments with the doctors by providing their name and phone number. In order to have access to all the features and benefits on our Website, a User must first create an account on our Website. To create an account, a User is required to provide the following information, which such User recognizes and expressly acknowledges is Personal Information allowing others, including Medicapp, to identify the User: name, User ID, email address, country, ZIP/postal code, age, phone number, password chosen by the User and valid financial account information. Other information requested on the registration page, including the ability to receive promotional offers from Medicapp, is optional. Medicapp may, in future, include other optional requests for information from the User to help Medicapp to customize the Website to deliver personalized information to the User.

This Privacy Policy applies to Services that are owned and operated by Medicapp. Medicapp does not exercise control over the sites displayed as search results or links from within its Services. These other sites may place their own cookies or other files on the Users’ computer, collect data or solicit personal information from the Users, for which Medicapp is not responsible or liable. Accordingly, Medicapp does not make any representations concerning the privacy practices or policies of such third parties or terms of use of such websites, nor does Medicapp guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites. The inclusion or exclusion does not imply any endorsement by Medicapp of the website, the website's provider, or the information on the website. If you decide to visit a third party website linked to the Website, you do this entirely at your own risk. Medicapp encourages the User to read the privacy policies of that website.

The Website may enable User to communicate with other Users or to post information to be accessed by others, whereupon other Users may collect such data. Such Users, including any moderators or administrators, are not authorized Medicapp representatives or agents, and their opinions or statements do not necessarily reflect those of Medicapp, and they are not authorized to bind Medicapp to any contract. Medicapp hereby expressly disclaims any liability for any reliance or misuse of such information that is made available by Users or visitors in such a manner.

Medicapp does not collect information about the visitors (except the registered Users for KYC verification to maintain an environment of genuine users) of the Website from other sources, such as public records or bodies, or private organisations, save and except for the purposes of registration and KYC verification of the Users (the collection, use, storage and disclosure of which each End User must agree to under the Terms of Use in order for Medicapp to effectively render the Services and maintain an environment of genuine and trusted users).

Medicapp maintains a strict "No-Spam" policy, which means that Medicapp does not intend to sell, rent or otherwise give your e-mail address to a third party without your consent.

Medicapp has implemented best international market practices and security policies, rules and technical measures to protect the personal data that it has under its control from unauthorised access, improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss. However, for any data loss or theft due to unauthorized access to the User’s electronic devices through which the User avails the Services, Medicapp shall not be held liable for any loss whatsoever incurred by the User.

Medicapp implements reasonable security practices and procedures and has a comprehensive documented information security programme and information security policies that contain managerial, technical, operational and physical security control measures that are commensurate with respect to the information being collected and the nature of Medicapp’s business.

Medicapp takes your right to privacy very seriously and other than as specifically stated in this Privacy Policy, will only disclose your Personal Information in the event it is required to do so by law, rule, regulation, law enforcement agency, governmental official, legal authority or similar requirements or when Medicapp, in its sole discretion, deems it necessary in order to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply the Terms of Use.

NOTE to HCP (Healthcare Providers):

This section applies to all Healthcare Providers.

As part of the registration as well as the application creation and submission process that is available to Healthcare Providers on Medicapp, certain information, including Personal Information or Sensitive Personal Data or Information is collected from the Healthcare Providers.

All the statements in this Privacy Policy apply to all Healthcare Providers, and all Healthcare Providers are therefore required to read and understand the privacy statements set out herein prior to submitting any Personal Information or Sensitive Personal Data or Information to Medicapp, failing which they are required to leave the Services, including the Website immediately.

Healthcare Providers’ personally identifiable information, which they choose to provide to Medicapp, is used to help the Healthcare Providers describe and identify themselves. This information is exclusively owned by Medicapp You will be the owner of your information and you consent to Medicapp collecting, using, processing and/or disclosing this information for the purposes hereinafter stated. Medicapp may use such information for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis and business intelligence purposes, and may sell or otherwise transfer such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates. Medicapp also reserves the right to use information provided by or about the Healthcare Provider for the following purposes:

Publishing such information on the Website.

Contacting Healthcare Providers for offering new products or services subject to the telephone number registered with the DNC Registry.

Contacting Healthcare Providers for taking product feedback.

Analyzing software usage patterns for improving product design and utility.

Analyzing anonymized practice information including financial, and inventory information for commercial use.

Medicapp automatically enables the listing of Healthcare Providers’ information on its Website for every ‘Doctor’ or ‘Clinic’ added to a Practice using its software. The Healthcare Provider information listed on Website is displayed when End-Users search for doctors on Website, and the Healthcare Provider information listed on Website is used by End-Users to request for doctor appointments. Any personally identifiable information of the Healthcare Providers listed on the Website is not generated by Medicapp and is provided to Medicapp by Healthcare Providers who wish to enlist themselves on the Website, or is collected by Medicapp from the public domain. Medicapp displays such information on its Website on an as-is basis making no representation or warranty on the accuracy or completeness of the information. As such, we strongly encourage Healthcare Providers to check the accuracy and completeness of their information from time to time, and inform us immediately of any discrepancies, changes or updates to such information. Medicapp will, however, take reasonable steps to ensure the accuracy and completeness of this information.

Medicapp may also display information for Healthcare Providers who have not signed up or registered for the Services, provided that the Healthcare Providers have consented to Medicapp collecting, processing and/or disclosing their information on the Website. Such Healthcare Providers are verified by Medicapp or its associates, and Medicapp makes every effort to capture accurate information for such Healthcare Providers. However, Medicapp does not undertake any liability for any incorrect or incomplete information appearing on the Website for such Healthcare Providers.

END-USERS NOTE:

Medicapp will communicate with the End-Users through email, phone and notices posted on the Website or through other means available through the service, including text and other forms of messaging. At times, Medicapp may conduct a User survey to collect information about End-Users' preferences. These surveys are optional and if End-Users choose to respond, their responses will be kept anonymous. Similarly, Medicapp may offer contests to qualifying End-Users in which we ask for contact and demographic information such as name, email address and mailing address. 1.End-Users using the Website by registering for an account on the Website or ‘Medicapp’ mobile application:

You can create an account by giving us information regarding your [name, mobile number, email address], and such other information as requested on the End-User registration page. This is to enable us to provide you with the facility to use the account to book your appointments and store other health related information.

Against every Healthcare Provider listed in www.medicapp.in , you may see a ‘show number’ option. When you choose this option, you choose to call the number through a free telephony service provided by Medicapp, and the records of such calls are recorded and stored in Medicapp’s servers. Such call will have an IVR message stating the purpose of recording your calls and your consent to such recordings which are dealt with as per the Privacy Policy. If you choose not to consent to recording of such call, Medicapp hereby reserves the right to not provide you the Services for which such Personal Information is sought. Such records are dealt with only in accordance with this Privacy Policy.

2.End-Users using the Website without registering for an account on the Website or ‘Medicapp’ mobile application (i.e., ‘Guest’ End-User):

You can use the Website without registering for an account, but to book an appointment, you may be asked certain information (including your [mobile number], and such other information as requested when you choose to use the Services without registration) to confirm the appointment.

3.Healthcare Provider availing of the free listing service on the Website or ‘Medicapp’ mobile application by registering for an account:

As a Healthcare Provider, you may be required to provide us with information regarding your [name, mobile number, email address], and such other information as requested on the HCP registration page to create an account. Medicapp may send email and/or SMS confirmations or other communications to End-Users in connection with their bookings, appointments or other interactions with you, if such interactions have been facilitated by Medicapp.

4. Healthcare Provider availing of the free listing service on the Website or ‘Medicapp’ application without registering for an account:

As a Healthcare Provider, you may avail of the listing service without registering for an account by providing information regarding your [name, mobile number, email address], and such other information as requested by any of Medicapp’s employees or agents who contact you in person or by telephone. In such event, Medicapp will maintain this information if and until you choose to register for an account, for which Medicapp may contact you from time to time. Medicapp will, after such information is collected from you, send you a confirmation email confirming the information provided and the fact that you will be listed on the Website. In the event you do not wish to be so listed on the Website, please inform Medicapp immediately at support@medicapp.in.

5.Healthcare Providers using the services of HCP under the sub-domain www.pro.medicapp.in

You will be required to create an account and may be required to provide Medicapp with information regarding your [name, mobile number, email address], and such other information as requested by Medicapp on the sub-domain, www.pro.medicapp.in registration page, in order to complete your registration.

Upon registration, Medicapp will access non-personally identifiable information of your patients from your patient records. You agree to make your patients fully aware of such access.

Medicapp reserves the right to extend and withdraw the functionality to You at its sole discretion, based on the number of End-User appointments being honoured by you. The extension or withdrawal of such facility shall be intimated to you by Medicapp.

You have an option under these products to switch on ‘End-User Feedback’. This will mean that you are giving one or more patients’ contact details to Medicapp’s feedback system. End-Users may choose to send feedback anonymously too, in which case you agree that you have no objection to such anonymous feedback. The feedback system will then send an SMS and email to the patient(s) asking for feedback which may then be published on the Website. You agree to make your patients fully aware of the possibility of their receiving such feedback queries.

Medicapp reserves the right, in its sole discretion, to change, modify, add or delete portions of the terms of this Privacy Policy at any time.
